Privacy Policy

This Privacy Policy describes how your “Personal Information” is collected, used, and shared when you visit or make a purchase from rmnco.com.au (the “Site”, “We”, “Us”).

 

This Policy is subject to change in order to reflect, for example, changes to our practices or for other operational, legal or regulatory reasons, at our discretion and we reserve the right to modify this Policy at any time.  The current version will always be available on our website at https://rmnco.com.au/pages/privacy-policy.

 

1. Purpose of the policy

a) Subject to exceptions, the Privacy Act 1988 (Cth) (Privacy Act) and the Australian Privacy Principles (APPs) govern the handling of Personal Information in Australia. If you are located in, or are a citizen of the European Union, you may have additional rights under the European Union General Data Protection Regulation (GDPR).  If you are located in another jurisdiction, additional local requirements will comply. In addition to the above, we also comply with the Australian Spam Act 2003 (Cth) (Spam Act), which deals with restrictions on sending unsolicited emails.

b) We are committed to complying with our obligations detailed above. This Policy sets out:

i) why and how we collect and use your Personal Information when you use the Site; and

​

ii) what controls you have over your Personal Information collected through using the Site.

 

2. Why we collect your Personal Information

a) We use this information to provide you with:

i) the best possible customer service and shopping experience;

ii) relevant marketing and remarketing across our websites and/or other marketing channels including social media.

 

3. Personal Information we collect

a) When we talk about “Personal Information” in this Privacy Policy, this refers to, but not limited to “Device Information” and “Order Information”.

i) information about your web browser, operating system and platform, IP address, time zone, location, and some of the cookies that are installed on your device. Additionally, your login data, as you browse the Site, we collect information about the individual web pages or products that you view, what websites or search terms referred you to the Site, and information about how you interact with the Site. We refer to this automatically-collected information as “Device Information.”

d) In order to provide you the best possible service, when you make a purchase or attempt to make a purchase through our Site, we may collect certain information from you. We refer to this information as “Order Information.” Data we may collect includes:

i) your name, company name, billing address, shipping address, payment information, email address, telephone number, date of birth, username or similar identifier, password and other details of products and services you have purchased from us;

ii) profile data including your username and password for registration of Site membership, date of birth, purchases or orders made by you, your interests, preferences, feedback, survey responses, customer service channels including social media, gift card redemption;

iii) usage data including information about how you use our website, products and services; or

​

iv) marketing and communications data including your preferences in receiving marketing from us and our third parties and your communication preferences.

 

4. How we collect Personal Information

a) We may collect Personal Information from you when you:

i) register on our website;

ii) communicate with us through correspondence, chats, email, or when you share information with us from other social applications, services or websites;

​

iii) subscribe to receive communications from us;

​

iv) purchase or attempt to purchase through the Site; or

​

v) otherwise interact with our website, services, content and advertising.

 

5. How do we use your Personal Information?

a) We will generally collect, use and hold your Personal Information if it is reasonably necessary for or directly related to the performance of our services, and for the purposes of:

i) enabling you to access and use our website;

iii) responding to your enquiries and information requests;

 

iv) providing you with promotional material and information about other services that we, our related entities and other organisations that we have affiliations with, offer that may be of interest to you;

vi) analysing our services and customer needs with a view to developing new or improved services; and

b) We use the Order Information that we collect generally to fulfill any orders placed through the Site (including processing your payment information, arranging for shipping, and providing you with invoices and/or order confirmations).  Additionally, we use this Order Information to:

ii) screen our orders for potential risk or fraud;

 

iii) when in line with the preferences you have shared with us, provide you with information or advertising relating to our products or services; or

 

iv) with based on your opt-in permissions and preferences, we may send you emails about our store, new products and other updates.

c) We use the Device Information that we collect to:

i) help us screen for potential risk and fraud (in particular, your IP address);

ii) more generally to improve and optimize our Site (for example, by generating analytics about how our customers browse and interact with the Site; and

iii) to assess the success of our marketing and advertising campaign

d) Unless you inform us that you opt out, we may use your Personal Information for the purposes of sending you emails to keep you updated with regards to our new products and specials. However, we will not disclose your Personal Information for the purposes of third-party direct marketing.

f) Using our website and cookies

i) While we do not use browsing information to identify you personally, we may record certain information about your use of our website, such as which pages you visit, the time and date of your visit and the internet protocol address assigned to your computer.

ii) We may also use google analytics and 'cookies' in order to enhance the website experience for our customers. Cookies are small files that store information on your computer, TV, mobile phone or other device. They enable the entity that put the cookie on your device to recognise you across different websites, services, devices and/or browsing sessions. You can disable cookies through your internet browser but our websites may not work as intended for you if you do so.

6. Consent

a) When you provide us with Personal Information to complete a transaction, verify your credit card, place an order, arrange for a delivery or return a purchase, we imply that you consent to our collecting it and using it for that specific reason only.

b) If we ask for your Personal Information for a secondary reason, like marketing, we will either ask you directly for your expressed consent, or provide you with an opportunity to say no.

c) To withdraw your consent you may:

i) opt out via the unsubscribe link in the footer of all email marketing campaigns sent by us. Once this link has been clicked, you must confirm this decision. Once confirmed, you will be removed from the list.

7. Sharing your Personal Information

a) We may share your Personal Information with third parties to help us use your Personal Information, as described above.

c) We also use Analytics via third party services to help us understand how our customers use the Site.

 

8. Third-party services

a) In general, the third-party providers used by us will only collect, use and disclose your information to the extent necessary to allow them to perform the services they provide to us.

b) Third-party service providers, such as payment gateways and other payment transaction processors, have their own privacy policies in respect to the information we are required to provide to them for your purchase-related transactions. For these providers, we recommend that you read their privacy policies so you can understand the manner in which your Personal Information will be handled by these providers.

 

c) Third party service providers may be located in or have facilities that are located a different jurisdiction than either you or us. So if you elect to proceed with a transaction that involves the services of a third-party service provider, then your information may become subject to the laws of the jurisdiction(s) in which that service provider or its facilities are located.

 

d) Once you leave our store’s website or are redirected to a third-party website or application, you are no longer governed by this Privacy Policy or our website’s Terms of Service.

 

e) We may disclose your Personal Information to employees and other associated companies for business purposes and marketing or remarketing purposes through our website, social media or marketing providers.

 

f) We may disclose your Personal Information to comply with any relevant laws. We may disclose your Personal Information to third party service providers to process sales, store and analyse data and information, provide web support, send marketing messages and deliver products. These third party providers may be located outside Australia. 

 

g) We will take reasonable actions to ensure third party recipients of this information do not breach GDPR and Australian Privacy laws in relation to the information we collect from you and may disclose.

9. Security

a) When you place an order through the Site, we will maintain your Order Information for our records unless and until you ask us to delete this information.

b) Our Site is hosted on the Wix.com platform. Wix.com provides us with the online platform that allows us to sell our products and services to you. Your data may be stored through Wix.com’s data storage, databases and the general Wix.com applications. They store your data on secure servers behind a firewall.

c) All direct payment gateways offered by Wix.com and used by the Site adhere to:

i) the standards set by PCI-DSS as managed by the PCI Security Standards Council, which is a joint effort of brands like Visa, MasterCard, American Express and Discover. PCI-DSS requirements help ensure the secure handling of credit card information by our store and its service providers.

ii) Wix has been audited and certified as ISO 27001 compliant. The ISO 27001 certification outlines industry best practices for managing security risks.

iii) Wix has been audited and certified as ISO 27018 compliant. The ISO 27018 certification outlines industry best practices for handling  personally Identifiable Information (PII) in a public cloud computing environment.

d) The Site takes all reasonable steps to protect Personal Information from misuse, interference and loss, and from unauthorised access, modification or disclosure. However, we cannot guarantee the security of information transmitted via the internet.  As such, transmission of Personal Information via the internet is at your own risk.

e) We have put in place procedures to deal with any suspected personal data breach and will notify you and any applicable regulator of a breach where we are legally required to do so.

f) Links to third-party websites may appear on our website. Unless expressly stated otherwise, we are not responsible for the privacy practices of, or any content on, those linked websites, and we make no representations or warranties regarding third parties’ privacy practices.

 

10. Minors

a) The Site is not intended for individuals who are not of legal age to form a binding contract with RMN Co.     

 

11. Overseas disclosure

a) We may disclose your Personal Information to third parties overseas for the purposes for which we collect and use that information.  This will generally be limited to third party providers of services such as payment processing, website hosting, data storage, electronic communications and data analysis.  Any such disclosure will be done in accordance with the Privacy Act.

b) We will attempt to ensure that persons to whom the disclosed Personal Information relates have comparable rights in relation to that information once disclosed overseas.

 

12. GDPR Compliance (Europe customers only)

a) If you are a European resident, your Personal Information is governed by the GDPR and you may have additional rights as set out below:

i) you have the right to access Personal Information we hold about you and to ask that your Personal Information be corrected, updated, or deleted. If you would like to exercise this right, please contact us through the contact information below.

ii) Additionally, if you are a European resident we note that we are processing your information in order to fulfill contracts we might have with you (for example if you make an order through the Site), or otherwise to pursue our legitimate business interests listed above.  Additionally, please note that your information will be transferred outside of Europe, including to Canada and the United States.
